SALES TERMS & CONDITIONS<\/strong><\/p>

1.ORDERS:\u00a0<\/strong>
\u2022 All orders are sent by e mail and are valid after payment confirmation.
\u2022 For special requests a drawing is required with all the details and dimensions
mentioned.
\u2022 Eventual variations must be consented and confirmed by our Company and will be valid only for the referred order .
\u2022 Once an order has been accepted by the Company , the Customer can only cancel, vary or suspend the order (whether in whole or in part) if the Company agrees in writing to such cancellation, variation or suspension.<\/p>

\u2022 For every order the Customer accepts our General terms and Sale conditions without reserve.<\/p>

2. PRICES:<\/strong>
\u2022 All prices are tax free.
\u2022 Prices are susceptible to variations without previous formal notice, due to raw material and labor cost increase. However, the price given at the time of order remains valid.
\u2022 Shipping costs, packaging costs and any other burden costs are not included. All prices are exclusive of any taxes or fees imposed by any federal, state, municipal, or other governmental authority that may be applicable to the sale, use, delivery, or transportation of the Goods. The foregoing, together with all duties, tariffs, valu e added taxes, brokerage charges, insurance, carriage, and
delivery charges shall be paid by the client . The client shall be responsible for the payment of such taxes and fees even if all or part thereof has not been
added to the invoice price and shall pr omptly pay the amount thereof upon demand.<\/p>

3.PAYMENTS:<\/strong><\/p>

\u2022 100% payment shall be paid in advance after order confirmation.<\/p>

\u2022 Payments made by the Buyer in advance to the Company can be accepted as Deposit to reserve the product(s). If the Buyer cancels the order at any time during the course of production, he is liable for costs incurred relating to the order up to that point. The deposit is non-refundable for special constructions. If the balance payment is not made within two (2) months period from order confirmation then the product(s) are considered available in the Company’s warehouse. When the balance payment is made a new delivery time will be given for the order.<\/p>

\u2022 The Payments in advance for special contructions must cover their total value when they are included in quotations with standard products.
\u2022 Payments can be made in our establishments or via wire transfer to our company\u00b4s bank account, as reported on the order confirmation and at the
bottom of this page.
\u2022 No approximations, arbitrary reductions or delays are admitted.<\/p>

4. DELIVERY TERMS:<\/strong><\/p>

\u2022 The production and approximate delivery time is time with the release of the proforma invoice.
\u2022 Delivery time depends on the availability of the products at the specific time of the order. Production time depends on the load of work at the specific time of order confirmation.
\u2022 All delivery dates are approximate, and the Company does not guarantee the date of delivery. The Company shall not be liable for any delay in delivery or
any other default due to occurrences or contingencies, including, but not limited to, fire, flood, embargo, strike, shut down, lockouts, failure to secure materials or labor from usual sources of supply, go vernmental restrictions, conditions considered \u201cforce majeure\u201d, delays occasioned by any subcontractors, misrouting, or any other circumstances beyond Company\u2019s control which shall prevent the Company from performing in the normal and usual course of its business.
\u2022 Unloading of goods shall be the Customer\u2019s responsibility and the Company will not be responsible for any damage whatsoever resulting from the unloading of the goods by the Customer or by anyone on its behalf, or by Customer \u2019s employee or agent.
\u2022 When goods are delivered to a particular site or when are subject to transshipments they will be entirely at the Customer\u2019s risk and responsibility even if the shipment order and the transport arrangements have been made by our Company at the request of the Buyer.<\/p>

5. WARANTEE:\u00a0<\/strong><\/p>

\u2022 BIOKAN GP guarantees ONE year warranty from the purchase date of all the
product s list , against any defect in the materials and the components used
during their fabrication.
\u2022 The Buyer or the End user is responsible for any damage caused due to wrong or improper use. The Buyer or the End user must follow strictly the instructions of the user manual.
\u2022 The Buyer should inspect the products immediately after the delivery and any complaints or arguments must be sent by e mail to our company within
five (5) business days.
\u2022 The risk of loss, destruction, or damage of the product during the shipping is the Buyer\u2019s or carrier\u2019s responsibility, even if the shipping order has been
given by our Company at the request of the Buyer.
\u2022 All repairs during the guarantee periods of 12 months, are performed in our
factory in Greece. The Buyer is responsible for the shipping of the products and covers exclusively the shipping cost.<\/p>

THE WARRANTY WILL NOT BE VALID UNDER THE FOLLOWING<\/strong><\/span>
CIRCUMSTANCES<\/strong><\/span><\/p>

i. <\/strong>When the Buyer or the End user does not follow strictly theinstructions of use in the manual.
ii.<\/strong> When the product has been misused, damaged, or exposed to any liquid or corrosive substance or for any other faults attributable to the Buyer or End user.
iii.<\/strong> When the product has been modified or repaired by non qualified personnel.
iv.<\/strong> When the fault is due to the normal wearing out of the product and its parts due to long term use.
v.<\/strong> When the damage is caused by liquids, chemicals or products that should not be poured inside the product.<\/p>

6. REGISTERED TRADEMARK<\/strong><\/p>

\u2022 The name ROASTER is officially recorded and cannot legally be used by another producer or company.<\/p>

\u2022 It is not permitted to use the domain www.roastergrills.xxx<\/p>

\u2022 It is required permission by the Company to use the trademark or logo on websites or any other marketing material unless it is for editorial or information purposes.<\/p>

7. <\/strong>LEGAL DISPUTES:<\/strong>
BIOKAN GP and its commercial transactions shall be governed by Greek law. For any legal dispute, Athens Greece courts are competent competent.<\/p>
