ORDERS:

All orders are sent by e-mail and are valid after payment confirmation.

• For special requests, a drawing is required with all the details and dimensions mentioned.

• Eventual variations must be consented and confirmed by our Company and will be valid only for the referred order.

• Once an order has been accepted by the Company, the Customer can only cancel, vary or suspend the order(whether in whole orin part) if the Company agrees in writing to such cancellation, variation or suspension.

• For every order the Customer accepts our General terms and Sale conditions without reserve.

PRICES:

All prices are tax free.

• Prices are susceptible to variations without previous formal notice, due to raw material and labor cost increase. However, the price given at the time of order remains valid.

• Shipping costs, packaging costs and any other burden costs are not included. All prices are exclusive of any taxes or fees imposed by any federal, state, municipal, or other governmental authority that may be applicable to the sale, use, delivery, or transportation of the Goods.The foregoing, together with all duties, tariffs, value added taxes, brokerage charges, insurance, carriage, and delivery charges shall be paid by the client.The client shall be responsible for the payment of such taxes and fees even if all or part thereof has not been added to the invoice price and shall promptly pay the amount thereof upon demand.

PAYMENTS:

• 100% payment shall be paid in advance after order confirmation.

• Payments can be made in our establishments or via wire transfer to our company’s bank account, as reported on the order confirmation and at the bottom of this page.

• No approximations, arbitrary reductions or delays are admitted.

DELIVERY TERMS:

•The production and approximate delivery time is communicated with the release of the proforma invoice.

• Delivery time depends on the availability of the products at the specific time of the order.Production time depends on the load of work at the specific time of order confirmation.

• All delivery dates are approximate, and the Company does not guarantee the date of delivery. The Company shall not be liable for any delay in delivery or any other default due to occurrences or contingencies, including, but not limited to, fire, flood, embargo, strike, shut down, lockouts, failure to secure materials or labor from usual sources of supply, governmental restrictions, conditions considered “force majeure”, delays occasioned by any subcontractors, misrouting, or any other circumstances beyond Company’s control which shall prevent the Company from performing in the normal and usual course of its business.

• Unloading of goods shall be the Customer’s responsibility and the Company will not be responsible for any damage whatsoever resulting from the unloading of the goods by the Customer or by anyone on its behalf, or by Customer’s employee or agent.

• When goods are delivered to a particular site or when are subject to transshipments they will be entirely at the Customer’s risk and responsibility even if the shipment order and the transport arrangements have been made by our Company at the request of the Buyer.

GUARANTEE:

• BIOKAN GP guarantees ONE-year warranty from the purchase date of all the products list, against any defect in the materials and the components used during their fabrication.

• The Buyer or the End user is responsible for any damage caused due to wrong or improper use. The Buyer or the End user must follow strictly the instructions of the user manual.

• The Buyer should inspect the products immediately after the delivery and any complaints or arguments must be sent by e-mailto our company within five (5) business days.

• The risk of loss, destruction, or damage of the product during the shipping is the Buyer’s or carrier’s responsibility, even if the shipping order has been given by our Company at the request of the Buyer.

• All repairs during the guarantee periods of12 months, are performed in our factory in Greece.The Buyer is responsible for the shipping of the products and covers exclusively the shipping cost.

THE WARRANTY WILL NOT BE VALID UNDER THE FOLLOWING CIRCUMSTANCES

1. When the Buyer or the End user does not follow strictly the instructions of use in the manual.

2. When the product has been misused, damaged, or exposed to any liquid or corrosive substance or for any other faults attributable to the Buyer or End user.

3. When the product has been modified or repaired by non-qualified personnel.

4. When the fault is due to the normal wearing out of the product and its parts due to long term use.

5. When the damage is caused by liquids, chemicals or products that should not be poured inside the product.

LEGAL DISPUTES:

• BIOKAN GP and its commercial transactions shall be governed by Greek law. For any legal dispute,Athens (Greece)courts are competent.
